General Terms and Conditions – Kado in Huis V.O.F.

These General Terms and Conditions apply to all offers, purchases, and agreements of Kado in Huis V.O.F., both via the webshop and in the physical store.

Article 2 – Definitions

In these terms, the following definitions apply:
Company: Kado in Huis V.O.F.
Customer: any consumer or business customer entering into an agreement
Agreement: any purchase agreement between Kado in Huis and the customer
Products: all items offered by Kado in Huis

Article 3 – Applicability

These General Terms and Conditions apply to all offers, orders, and agreements.
Deviations are only valid if agreed upon in writing.
Any general terms and conditions of the customer are expressly excluded.

Article 4 – Offers

All offers are non-binding unless stated otherwise.
Obvious errors or mistakes do not bind Kado in Huis.
Product images are for illustrative purposes only and may slightly differ from the actual product.

Article 5 – Agreement

In the webshop, the agreement is concluded at the moment the order is placed and confirmed by email.
In the physical store, the agreement is concluded upon payment at the checkout.
Kado in Huis reserves the right to refuse orders for justified reasons.

Article 6 – Prices

All prices are stated in euros and include VAT unless stated otherwise.
Shipping costs are clearly displayed before completing an online order.
Price changes do not affect agreements already concluded.

Article 7 – Payment

Payment in the webshop is made via the available payment methods.
Payment in the physical store is made in cash or by debit card.
Orders are processed only after full payment has been received.

Article 8 – Delivery (Webshop)

Kado in Huis strives to deliver online orders promptly.
Delivery times are indicative and not binding deadlines.
In case of delay, the customer will be informed as soon as possible.

Article 9 – Right of Withdrawal (webshop only)

The customer has the right to withdraw from the online purchase within 14 days after receipt, without giving any reason.
The product must be returned unused and, where possible, in its original packaging.
After withdrawal, the product must be returned within 14 days.
Return shipping costs are borne by the customer unless otherwise agreed.

Article 10 – Exclusion of the Right of Withdrawal

The right of withdrawal does not apply to purchases made in the physical store, unless stated otherwise.

Article 11 – Refunds

After proper withdrawal, the purchase amount will be refunded within 14 days.
Kado in Huis may withhold the refund until the product has been received or proof of return shipment has been provided.

Article 12 – Warranty and Conformity

Kado in Huis guarantees that the products comply with the agreement and legal requirements.
Any defects must be reported within a reasonable period after discovery.
The statutory warranty applies, meaning the product must meet reasonable consumer expectations.

Article 13 – Complaints

Complaints may be submitted by email or in the store.
Kado in Huis aims to handle complaints within 14 days.

Article 14 – Liability

Kado in Huis is not liable for indirect or consequential damage.
Liability is limited to the amount of the purchase.
This limitation does not apply in cases of intent or gross negligence.

Article 15 – Force Majeure

Kado in Huis is not obliged to fulfill obligations in the event of force majeure.
Force majeure refers to any circumstance beyond the company’s control.

Article 16 – Privacy

Personal data is processed in accordance with applicable privacy legislation. Please refer to the privacy policy on the website.

Article 17 – Applicable Law

All agreements are governed by Dutch law.
Disputes will be submitted to the competent court in the Netherlands.

Article 18 – Amendments

Kado in Huis reserves the right to amend these terms and conditions. The most recent version is always available on the website.
